Official Rules for Katy Perry Concert Tickets
ELIGIBILITY: The Katy Perry Concert Tickets for Horizons National Raffle (the “Raffle”) is open and offered only to legal residents of the 50 United States of America and Washington D.C. who are at least 21 years of age or older at the time of entry. Employees and volunteers of Horizons National, Katy Perry, Allison Williams, their immediate families (parent, child, sibling or spouse) and/or household members and any other persons employed by, or volunteering with, entities associated with this promotion are ineligible to enter or win. Void in Puerto Rico and where prohibited by law.
ADMINISTRATOR: The administrator of the Raffle is Horizons National, 120 Post Road West, Suite 202 Westport, CT 06880 (the "Administrator").
AGREEMENT TO OFFICIAL RULES: By participating, entrants agree to abide by and be bound by these Official Rules and the decisions of the Administrator, which are final and binding in all matters relating to the Raffle. Winning any prize is contingent upon fulfilling all requirements set forth herein.
HOW TO ENTER: The Raffle begins at 7:30 PM Eastern Time (“ET”) on July 26, 2017 and ends at 11:00 PM ET on July 27, 2017 (“Raffle Period”). For each $40 donation to Allison’s 10 Days of Giving during the Raffle Period, you will be automatically entered into the Raffle. No donation or purchase is required to enter. To enter without making a donation or purchasing any goods during the Raffle Period (an "Alternative Entry"), entrants must email firstname.lastname@example.org with Katy Perry Concert Tickets Alternate Entry in the subject line and name and shipping information in the email body. Limit one Alternative Entry per person during the Raffle Period. All Alternative Entries must be received via email by 10:30 PM ET on July 27, 2017. Purchases made for other items sold on www.awloveshorizons.org will not be deemed an entry into the Raffle or an Alternative Entry.
The Administrator are not responsible for late, incomplete, misdirected, or delayed entries, including due to any internet failure. Incomplete information may result in disqualification of entry. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. No mechanical reproductions or facsimiles of entries allowed. All entries become the exclusive property of Administrator and will not be acknowledged or returned.
DRAWING AND NOTIFICATION: Two (2) Winners (the "Winners") will be selected in a random drawing from among all eligible entries received at the end of the Raffle Period. The drawing will be conducted on or about July 28, 2017 at 9:00am ET by the Administrator. Odds of winning will depend on the total number of eligible entries received. The Winner will be contacted via the email address provided in the Winner's contribution form and will be announced via social media posting.
PRIZES: Two (2) Winners will receive two Floor Tickets in "Drop Zone" to a concert (of the winner's choice) to any show during the North American Leg of Katy Perry's Witness: The Tour. Travel and accommodations are not provided and will at the expense of the winner. Approximate Retail Value (“ARV”) of prize package is $500 (the “Prize”).
PRIZE CONDITIONS: By participating in the Raffle, including by accepting any Prize, the Winner agrees to release the Administrator from any and all liability whatsoever for any injuries, losses, or damages of any kind caused by or related to entering the promotion or from acceptance, possession, or use/misuse of prize awarded. All local, state and federal taxes are solely the responsibility of the winner and/or any other fees/costs associated with the receipt of any prize, and Administrator and the shall have no responsibility or liability related thereto. No substitution or transfer of prize or election of cash in lieu of prize will be permitted. The winner will be required to complete and return the following forms, to be provided by Administrator, within ten (10) days of written notification or the Prize may be forfeited and an alternate winner selected: (i) an Affidavit of Eligibility and Liability/Publicity Release which will, among other items, allow the Administrator to use the name and likeness of the Winner, and (ii) a W-9 form . The Winner will also be required to disclose his/her social security number so that the Administrator may issue a 1099 Form for tax purposes. The Administrator reserves the right to, at its sole discretion, substitute any prize package with another prize of equal or greater value in the event that the Prize (or any component thereof) is not available. If a Prize or Prize notification is returned as unclaimed or undeliverable to a potential winner, if a potential winner cannot be reached within three (3) calendar days from the first notification attempt, or if a potential winner fails to return requisite documents within the specified time period, or if a potential winner is not in compliance with these Official Rules, then such person shall be disqualified and an alternate winner will be selected for the prize at issue. The Winner’s entry, and acceptance of the Prize offered, constitutes permission (except where prohibited) for the Administrator to use the Winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state), in all forms of media, in perpetuity, without notice or further compensation.
GENERAL CONDITIONS: If for any reason the operation or administration of this Raffle is impaired or incapable of running as planned for any reason, including but not limited to (a) infection by computer virus, bugs, (b) tampering, unauthorized intervention, (c) fraud, (d) technical failures, or (e) any other causes beyond the control of the Administrator which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Raffle, the Administrator reserves the right to, at its sole discretion and without notice, cancel, terminate, modify or suspend this Raffle in whole or in part and not award the Prize or take such other steps that are fair and equitable and best conforms to the spirit of these Official Rules. The Administrator reserves the right to, at its sole discretion, disqualify any individual deemed to be (i) tampering or attempting to tamper with the entry process or the operation of the Raffle, including tampering with the Administrator’s websites; or (ii) acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Administrator may, in such case and at its sole discretion, proceed with the Raffle using all non-suspect eligible entries. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE RAFFLE IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE ADMINISTRATOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. Failure by the Administrator to enforce any provision of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to the identity of a winner based on an email address, such winning entry will be declared won by the authorized account holder of the email address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned an email address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
RELEASE AND LIMITATIONS OF LIABILITY: By participating in the Raffle, entrants shall and hereby do irrevocably release and hold harmless the Administrator, and its respective parents, employees, officers, directors, subsidiaries, affiliates, distributors, sales representatives, advertising and promotional agencies (collectively, the “Released Parties”) from and against any claim or cause of action, and any and all liability for any injuries, death or losses or damages to persons or property arising out of participation in the Raffle or receipt or use of any prize, including, but not limited to: (a) any technical errors that may prevent an entrant from submitting an entry; (b) unauthorized human intervention in the Raffle; (c) errors in the administration of the Raffle or the processing of entries; (d) any changes in third party terms of conditions; (e) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, by entrant’s participation in the Raffle or its related activities; (f) the acceptance, possession, use or misuse of, or any harm resulting from the acceptance, possession, use or misuse of, the Prize; or (g) violation of intellectual property or publicity rights, and/or invasion of privacy that may arise from participating in this Raffle or its related activities. Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Released Parties are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by Administrator on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to entrant's or any other person's computer relating to or resulting from participation in this Raffle or downloading any materials connected to this Raffle. Each entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Raffle, and in no event shall the Released Parties be liable for attorney’s fees.
GENERAL: By accepting a prize, each Winner grants to the Released Parties and those acting pursuant to the authority of Administrator and the Released Parties (which grant will be confirmed in writing upon Administrator's request), where permitted by law, the right to print, publish, broadcast, display or otherwise use worldwide IN ALL MEDIA, without limitation and at any time, such Winner’s full name, portrait, picture, voice, likeness and/or biographical information for advertising, trade and promotional purposes, without payment or additional consideration from Administrator, and without such Winner's review, approval or notification. IN NO EVENT WILL RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING OUT OF PARTICIPATION IN THIS RAFFLE OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE, AND ENTRANT WAIVES THE RIGHT TO SEEK SUCH DAMAGES. The Winner acknowledges that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Prize.
GOVERNING LAW AND DISPUTES: The Raffle, the rights and obligations of entrants, the Administrator in connection with the Raffle and these Official Rules, including all issues and questions concerning the construction, validity, interpretation and enforceability thereof, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules of any jurisdiction which would cause the application of the laws of any jurisdiction other than the State of New York. Except where prohibited, (1) any dispute, claim or cause of action of any kind arising out of, relating to or connected with the Raffle, any prize awarded , the rights and obligations of entrants, the Administrator in connection with the Raffle, or these Official Rules, including all issues and questions concerning the construction, validity, interpretation and enforceability thereof (a "Dispute"), shall be resolved exclusively by the state and federal courts located in New York County, New York, and entrants hereby irrevocably and unconditionally submit to the exclusive jurisdiction of such courts for any Dispute; and (2) any lawsuit or other proceeding with respect to any Dispute in any court or forum must be brought on an individual basis. This means neither any entrant nor we can litigate any claims as a representative or member of a class or in a private attorney general capacity.
